These Viber Business Payments Request Terms and Conditions (the “Business Payments Request Terms” or “Terms”) form a legally binding agreement by and between Viber Media S.à r.l. (“Viber”, “we”, or “our”) and you, the company or business (“Business” or “you”) governing the Business’ use of the payments request feature as detailed below (the “Business Payments Request”). These Terms form part of the Viber Business Accounts Terms and Conditions (the “Business Accounts Terms”), and is supplemented where applicable by the Viber Terms of Service, which govern your overall use of Viber’s services, and the Viber Acceptable Use Policy. In the event of any conflict between these Terms and the Business Accounts Terms or any additional Viber terms and policies, these Terms shall prevail with respect to the Business Payments Request feature.
BY ENABLING BUSINESS PAYMENTS REQUESTS ON A BUSINESS ACCOUNT AND/OR USING THE BUSINESS PAYMENTS REQUESTS FEATURE, THE BUSINESS AGREES TO BE BOUND BY THESE TERMS AND ALL OTHER APPLICABLE TERMS AND POLICIES, AND ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THEM. PLEASE READ THESE TERMS CAREFULLY BEFORE ACCEPTING THEM. PLEASE DO NOT ENABLE OR USE THE BUSINESS PAYMENTS REQUESTS FEATURE IF YOU DO NOT AGREE TO ALL OR ANY PART OF THESE TERMS.
YOU HEREBY AGREE TO USE THE BUSINESS PAYMENTS REQUEST FEATURE ONLY FOR BONA FIDE, VALID AND LAWFUL TRANSACTIONS BETWEEN THE BUSINESS AND YOUR CUSTOMERS, AND TO ACCURATELY DESCRIBE THE BUSINESS PRODUCTS SOLD.
Viber reserves the right to amend or update these Terms at any time, as further laid out under the Business Accounts Terms. Your continued use of the Business Payments Request feature after any such update constitutes acceptance of the revised terms.
Unless otherwise stated, capitalized terms not defined herein have the meanings given in the Business Accounts Terms.
1. BUSINESS PAYMENTS REQUEST
1.1 The Business Payments Request feature allows Business Accounts the option to send payment request links to its customers within Business Account chats. The payment request links are generated from the payment account of the Business with supported third-party payment services provider/s (the “PSP”), in accordance with such PSP’s terms and policies. Viber may, at any time, add or remove supported PSPs at its discretion.
1.2 Viber provides the platform or limited infrastructure necessary for the Business to connect and link its payment account with a PSP to its Business Account for the purpose of the enabling or using Business Payments Requests feature. Thereafter, the Business may generate a payment request by entering the payment amount and description within the chat settings, which Viber transmits to the Business’ PSP via API to automatically generate the payment request link. For avoidance of doubt, a payment request link, once generated, functions independently of the Viber platform.
1.3 By enabling the Business Payments Request feature, you authorize Viber to access, use, and interact with your PSP on your behalf in order to operate the feature, including to generate payment request links, receive and display limited transaction status information, and retrieve and store your merchant identity and account information.
1.4 Each Business Account may be linked to one (1) payment account from each supported PSP only. Viber reserves the right to increase or change this restriction at any time and at its sole discretion.
1.5 The Business Payments Request feature is currently available in Ukraine only. Viber reserves the right to make the feature available in additional markets where permissible by applicable law.
1.6 Viber may modify, suspend, restrict or discontinue the Business Payments Request feature at any time and at its sole discretion.
2. PAYMENT PROCESSING
2.1 All payments are processed solely by the supported PSPs that a Business has a payment account with and in accordance with such PSP’s terms and policies, and not by Viber.
2.2 The Business agrees and acknowledges that Viber and its affiliates will not process any payments or act as a service provider to any payment processors, and will not receive, transfer, process, settle, store, or otherwise maintain any possession, custody, or control of any funds paid by any user, or received by any Business, in connection with any transaction using this feature.
2.3 When a Business’ customer opens a payment request link, the user is redirected to a payment interface hosted entirely by the PSP. All payment information of the customer, including but not limited to, card information and account numbers are entered on the PSP’s platform. Viber does not collect or have access to any such payment details.
2.4 Viber makes no representations or warranties, whether express, implied, statutory or otherwise, with respect to any PSP or the services they provide. Viber allowing businesses to enable or use the Business Payments Request feature is not a representation that a customer has sufficient funds nor that the payment transaction will be successfully authorized or processed by the PSPs.
3. TRANSACTIONS, FEES AND TAXES
3.1 All transactions in connection with or arising from any payment requests are solely between the Business and its customer. Viber is not a party to any such transactions.
3.2 The Business shall use the Business Payments Request feature only for bona fide, valid and lawful transactions and to accurately describe the Business Products sold.
3.3 Viber does not currently charge any fees to the Business for the use of the Business Payments Request feature. Viber reserves the right to introduce fees upon prior notice. The Business acknowledges that its PSP may charge separate and independent fees for processing any transactions, which are calculated and collected by the PSP directly. The Business is solely responsible for paying such fees where applicable.
3.4 The Business is the seller of record for the Business Products provided through the use of this feature and agrees to comply with all applicable tax laws and regulations. Where applicable, the Business is solely responsible for all determinations, calculations, collections, withholdings, reporting and remittance of applicable taxes, duties, fees and other additional charges arising from any transaction. Viber is not obligated to determine whether applicable taxes apply, and is not responsible to collect, report or remit any taxes arising from any payment request transaction.
4. BUSINESS OBLIGATIONS
4.1 In order to enable or use this feature, the Business must hold and maintain a valid and subsisting account with a supported PSP, and must comply with that provider’s terms and policies at all times. Viber has no relationship nor affiliation with your PSP for purposes of this feature.
4.2 The Business is solely responsible for: (a) the Business Products, including the accuracy of its description, offered in connection with any payment request; (b) the accuracy and completeness of any payment request information; (c) investigating and resolving all disputes with its customers, including returns and refunds of any Business Products purchased; (d) all customer support, chargebacks, and complaints relating to any transaction; and (e) maintaining the confidentiality and security of its payment account credentials, including account key numbers.
4.3 The Business must not use the Business Payments Request feature for any purpose prohibited by applicable laws or regulations, the Business Accounts Terms, including the sale of products or services listed on the Prohibited Products and Services List or engaging in practices that violate the Fair Usage Policy, these Terms and any other applicable Viber terms or policies.
4.4 The Business shall ensure that any data inputted, stored or transmitted in connection with any payment request or transaction is accurate, complete, and secure. The Business shall be solely responsible for reviewing its transactions on a regular basis to identify and mitigate any actual or suspected unauthorized or fraudulent activity.
5. USE RESTRICTIONS
In connection with the Business Payments Request feature, the Business must not, and must not enable or permit others to:
- modify or interfere with the functionality, security, or user experience of the feature or the Viber platform;
- provide false, fraudulent or misleading information in connection with any payment request or transaction;
- use the feature in connection with any illegal, prohibited or illicit transaction;

- otherwise use the feature in violation of these Terms, any Viber terms or policies, or any other applicable laws or regulations;
6. DATA PROTECTION
6.1 By enabling the Business Payments Request feature, Viber stores the Business’ payment account number and encrypted key credentials. Viber does not independently verify the Business’ identity and relies on the verification performed by the PSP.
6.2 In connection with payment requests, Viber processes the following data: payment amount, currency, payment description (as entered by the Business), payment status, payment link URL, and invoice ID (as generated by the PSP upon payment). Viber uses this data to operate, provide, and maintain the Business Payments Request feature, including to provide Businesses a mechanism to generate payment requests seamlessly within the chat, and display transaction status information between the Business and its customer. The foregoing data will be retained for up to six (6) months from the date of the relevant transaction or until deactivation of the relevant Business Account, whichever occurs earlier.
6.3 Viber does not collect or have access to payment account details, payment account credentials, or other financial information entered by users on the PSP’s hosted platform.
6.4 Unless otherwise stated herein, the personal data processed in connection with this feature is governed by the Viber Privacy Policy, which supplements these Terms. The PSP processes payment data independently under its own terms and privacy policy. Viber encourages all users to review the applicable PSP’s terms and privacy policy.
6.5 Upon disconnection or deactivation of the Business Account, Viber will delete the Business’ payment account information and encrypted credentials.
7. DISCLAIMERS AND LIMITATION OF LIABILITY
BUSINESSES USE THE BUSINESS PAYMENTS REQUEST FEATURE AT ITS OWN RISK AND DISCRETION. UNLESS PROHIBITED BY APPLICABLE LAW, THIS FEATURE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND VIBER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, AND FREEDOM FROM COMPUTER VIRUS OR OTHER HARMFUL CODE. VIBER SHALL NOT BE LIABLE FOR LOST PROFITS, REVENUES, BUSINESS OPPORTUNITIES, ANTICIPATED SAVINGS, GOODWILL, DATA, OR ANY CONSEQUENTIAL, SPECIAL, PUNITIVE, INDIRECT, OR INCIDENTAL DAMAGES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STATUTE, STRICT LIABILITY, OR ANY OTHER THEORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBER’S AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS (USD 100) OR THE AMOUNT THE BUSINESS HAS PAID VIBER IN THE PAST TWELVE (12) MONTHS IN CONNECTION WITH USE OF ANY BUSINESS PAYMENTS REQUEST.
8. INDEMNIFICATION
In addition to the indemnification obligations under the Business Accounts Terms, the Business agrees to defend, indemnify, and hold harmless Viber and its directors, officers, employees, affiliates, and agents from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to any of the following (“Claim”): (a) the Business’ access to or use of the Business Payments Request feature, including information provided in connection therewith; (b) the Business’ breach or alleged breach of these Terms or applicable law; (c) any transaction, including any dispute with any customer or Viber user; (d) any misrepresentation by the Business; or (e) any applicable taxes, duties, fees, and additional charges against the Business arising from transactions. Viber has the right to solely control the defense or settlement of any such Claim, and the Business will fully cooperate with Viber in this regard.
9. TERMINATION
9.1 Viber may restrict, suspend or terminate the Business’ access to or use of the Business Payments Request feature at any time, including where Viber reasonably believes the Business has violated these Terms, any other Viber terms or policies, any applicable law or regulation, or to prevent loss or harm to users, Viber, or any other third party.
9.2 You may stop using the Business Payments Request feature at any time by disconnecting your payment account under supported PSPs through the Business Account settings.
