Viber 10th Anniversary End of the Year Campaign Terms and Conditions
We are happy that you wish to take part in the Viber 10th Anniversary End of the Year Campaign (the “Campaign“). These Terms & Conditions (the “Terms“) govern your participation in the Campaign. By participating in the Campaign, you agree to be bound by these Terms, so please read these Terms carefully. If you do not agree to be bound by these Terms, you should refrain from participating in the Campaign. “Viber” means Viber Media S.à r.l., a company incorporated in the Grand Duchy of Luxembourg, having offices at 2 rue du Fossé, L-1536 Luxembourg.
Participation. In order to participate in the Campaign, you must have a valid Viber account registered with the phone number of any of the following countries: Russia, Belarus, Bangladesh, Myanmar, Hungary, Bulgaria, Croatia, Serbia, Slovakia, Greece, Ukraine, United Kingdom, France, Germany, Italy, Spain, Sri Lanka, Egypt, Kuwait and be at the legal age of consent to form a binding agreement in your country (or older), but in any event not less than 16 years old.
VOID IN ALL TERRITORIES WHERE PROHIBITED BY LAW.
- General
1.1 During the Term of the Campaign (as defined below), and subject to the quantities stated in the Gifts Table below, users of the Viber App that have accessed and subscribed to the Viber Wheel Bot (the “Bot”) will be granted one option to be awarded a random gift from a selection of gifts provided by Viber and its Partners under the Campaign, and an option to share an invite to the Bot with others, and receive an additional option to be awarded an additional gift (each such user, a “Participant”). If you have received an invite from a Viber user, then you will be redirected to the Bot and may become a Participant. You may not enter the Bot more than once, by using multiple identities or devices in an attempt to circumvent an orderly conduct of the Campaign as set forth under these Terms. If you use fraudulent methods or otherwise attempt to circumvent these Terms and an orderly conduct of the Campaign, your entry may be removed from eligibility at the sole discretion of Viber.
The terms and conditions set forth in the PA, PC and Bot Terms and Guidelines available at https://www.viber.com/terms/chat-public-accounts-terms-guidelines/, as amended from time to time, shall apply to the Bot and the Participants’ engagement therewith.
1.2 Participation in the Campaign is free of charge and does not require making any purchase or paying any fee to Viber. If your Gift is provided by one of the Partners, you may have to be asked to make a purchase at such Partner in order to be able to take advantage of the Gift.
1.3 The Campaign shall take place between: 1) for Russia, Armenia, Georgia, Ukraine, Belarus and Serbia – between December 1, 2020, 00:01 and December 31, 2020, 23:59 (GMT+2); and for the rest of the countries mentioned above – between December 1, 2020, 00:01 and December 25, 2020, 23:59 (GMT+2) (the “Term”).
1.4 Entry to the Bot shall be considered an “Entry” and participation in the Campaign, and is subject to the Terms hereof.
1.5 Viber assumes no responsibility for Entries not received on time or at all for whichever reason, including due to a technical error or malfunction.
- Gifts
2.1 Subject to the terms and conditions provided under these Terms, Participants which will make a Spin (as defined below) within the time frame indicated below, will be entitled to receive one of the gifts from the Gift Table below, which will be chosen randomly by the Bot (the “Gifts”).
2.2 It is acknowledged that some of the Gifts are provided by the Partners described below in the Gifts Table. The eligibility, redemption, use and exercise of each Partner’s Gift is solely subject to the specific terms and conditions of each Partner appearing against the relevant Partner’s Gift under the column “Terms” in the Gifts Table. All Partner’s Gifts are provided “as is” without any warranty, representation, or guarantee, express or implied, in fact or in law, whether now known or hereinafter enacted, relative to the redemption, exercise, use or enjoyment of the Partner’s Gift, including, without limitation, its quality, merchantability, or fitness for a particular purpose and Viber hereby expressly disclaims any responsibility and/or liability whatsoever with respect to any aspect of the Partner’s Gifts, including inter alia in connection with the eligibility for, validity, redemption, exercise and use of such Partner’s Gifts.
2.3 No cash alternative to the Gifts will be offered. The Gifts are offered on a ‘NO EXCHANGE, NO REFUND’ basis and are not transferable. Any redemption and use of any Gift, as well as any and all Gift-related expenses, if any, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the Participant. No substitution of Gift or request for the cash equivalent by Participant shall be allowed.
2.4 In order to receive the Gift the Participant will be offered to spin the virtual “wheel” by clicking on a prompt within the Bot, which will constitute an eligible spin (the “Spin”). Promptly after the Spin is made, the Participant shall receive indication of the Gift which has been randomly selected and automatically assigned to him. Each Participant is eligible for one Spin only, and the Gifts are limited to one Gift per one Participant’s Spin only (i.e. either one Viber Out Coupon or one Sticker Pack or one Voucher – to be distributed upon the availability and chosen randomly by the Bot). However, if the Participant shares the Bot with at least three (3) other Viber users (“Invitees”) by clicking on the “Invite Now” button within the Bot (which will appear after winning the first Gift), and at least three (3) of such Invitees accept the invitation by tapping on that invitation link and entering the Bot, such inviting Participant shall be entitled to receive one extra Spin and a chance to receive one additional Gift. In any event the Participant shall not be eligible for more than a total of two (2) Spins, and, correspondingly, two (2) Gifts.
2.5 Each Participant hereby acknowledges that the availability of Gifts during the Campaign is not guaranteed, that the pool of Gifts may be fully exhausted prior to the end of the Term, and Participant shall have no right or entitlement in connection thereof, and Viber shall have no obligation whatsoever to replenish the Gifts and/or provide Participant with alternatives. Without derogating from any provisions hereunder and in addition to Section 3.3 below, the Participant hereby confirms its non-reliance on the Gifts availability and waives, to the maximum extent permitted under applicable law, any and all claims whatsoever that it may have in connection thereof or with respect to the eligibility for Gifts.
2.6 Viber reserves the right to change, modify and cancel the Campaign or any part thereof (including by way of limiting the use of the Gifts, adding or reducing the number of Gifts and/or opportunities, or canceling any and all Gifts etc.), or discontinue this Campaign at any time without notice, at Viber’s sole discretion, and without any liability on its part. Viber’s decisions on all matters involving the Campaign will be final and binding.
3. Limitation of Liability; No Warranty
PLEASE BE ADVISED THAT APPLE INC. IS NOT A SPONSOR OR INVOLVED IN THE ACTIVITY IN ANY MANNER.
3.1 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIBER AND EACH OF ITS AFFILIATES, AND/OR EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, SERVANTS OR AGENTS SHALL NOT BE LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGE ARISING FROM YOUR PARTICIPATION IN THE CAMPAIGN OR ANY OTHER CLAIM RELATED IN ANY WAY TO THE CAMPAIGN. THESE EXCLUSIONS INCLUDE, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN IF VIBER HAD BEEN ADVISED OF THE POSSIBILITY THEREOF AND REGARDLESS OF THE LEGAL OR EQUITABLE THEORY UPON WHICH THE CLAIM IS BASED. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, VIBER’S LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW.
3.2 EVERYTHING ON VIBER IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. PARTICIPANTS AGREE AND ACKNOWLEDGE THAT ALL GIFTS ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, WHETHER NOW KNOWN OR HEREINAFTER ENACTED, RELATIVE TO THE USE OR ENJOYMENT OF THE GIFT, INCLUDING, WITHOUT LIMITATION, ITS QUALITY, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. FURTHER, NO RESPONSIBILITIES ARE ACCEPTED FOR ANY ADDITIONAL EXPENSES, OMISSIONS, DELAYS, OR RE-ROUTING RESULTING FROM ANY ACTS OF ANY GOVERNMENT OR AUTHORITY.
3.3 BY PARTICIPATION IN THE CAMPAIGN, YOU HEREBY RELEASE VIBER AND EACH OF ITS AFFILIATES AND SUBSIDIARIES AND/OR EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS OR AGENTS, TO THE MAXIMUM EXTENT PERMITTED BY ANY APPLICABLE LAW, FROM AND AGAINST ANY AND ALL LIABILITY, LOSS, CLAIMS, DEMANDS OR ACTIONS OF ANY KIND WHATSOEVER WITH RESPECT TO INJURIES, DAMAGES, OR LOSSES, TO PERSONS OR PROPERTY, WHICH MAY BE SUSTAINED IN CONNECTION WITH SUBMITTING AN ENTRY, A SPIN, GIFTS, PARTICIPATION IN THE CAMPAIGN OR WITH RESPECT OF ANY ASPECT OF THE CAMPAIGN.
4. Miscellaneous
The Campaign and these Terms are governed by the laws of England and Wales, without regard to the conflict of laws principles. As a condition of participating in this Campaign, a Participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court located in London, UK. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including attorneys’ fees.
